MINUTES OF THE PUBLIC MEETING OF SEPTEMBER 23, 2008
TOWN HALL, 542 LIBERTY STREET, HANSON, MA

Called to Order at 7:30 PM under M.G.L. Chapter 131, s.40 and the Hanson By-Law 3-13, s.5. by Frank Schellenger, Vice Chairman, in Meeting Room A at the Town Hall.

Public Hearings

7:30 PM  Continued Notice of Intent for the construction of a driveway across wetlands and Spring Brook to gain access to reach a 3 ¼ acre island of upland at Lot 3 Lakeside Road, Map 88, parts of Lots 7 & 8 for RHD Realty Trust represented by Vautrinot Surveying, Inc., P.O. Box 144, Plympton, MA  (DEP #SE175-0558)

7:45 PM  Request for Determination of Applicability for perc testing for the future repair of a failing septic system at 45 Ocean Ave., Map 2, Lot 1508 for Linda L. Hauge represented by John W. Delano & Associates, Inc., 220 Hudson Street, Halifax, MA  02338  (New Hearing)

John Kemmett read the Public Hearing Notice and the abutters were verified.  John Delano submitted a stamped plan and made the presentation for a proposal to perform perc tests.  He explained that the septic was failing and was in need of repair.  He also requested a variance from the 50-foot no build setback.

Order of Conditions

Order of Conditions for the construction of a 2-car garage attached to an existing dwelling and the installation of a paved driveway with grading at 301 Indian Head Street, Map 54, Lot 7C & a portion of Lot 49-1 for Jon Ridder  (DEP #SE175-0556)  - signed


Request for Certificate of Compliance

Mr. Vacca recommended that a final COC be delayed until confirmation is received from the Board of Appeals that there are no outstanding issues.

·       Bonney Hill Lane, Map 56, Lots 116 & 108A/B for Constance Doolittle
(DEP #SE175-357)

Mr. Vacca recommended approval of a final COC as all outstanding issues have been addressed satisfactorily.  Mr. Paul Mirabito of Ross Engineering attended the meeting to submit proof that the pedestrian walkway easement had been recorded at the Registry of Deeds.

Mr. Vacca, in response to a Request for COC, had conducted a site inspection last week.  The site was stable and in accordance with the approved plan.  Mr. Vacca recommended approval.

Activities  (Report by Agent)

Indian Head St – Chapter 61 Issue
Mr. Vacca consulted Ms. Cindy Long, Town Assessor, regarding the parcels of land that comprise 301 Indian Street.  She confirmed that no part of these parcels were ever in Chapter 61 and so the question of the Town having the right of first refusal was moot.



Perc Test Procedure  
Mr. Vacca reported that we have negotiated with Board of Health to be notified of perc tests by way of e-mail.
Indian Head Pond Boat Launch
Mr. Vacca reported that he e-mailed Al Hanscom and had not heard back as of yet.
OS&R Plan  
The Open Space and Recreation meeting is scheduled for next Tuesday at Camp Kiwanee.  The purpose of the meeting is to review the Draft Plan.
Indian Trail  
Mr. Vacca  met with Dick Harris of the Highway Department regarding the permitting process for the headwall repair.  The botanist has flagged the wetlands and Land Planning is preparing a Notice of Intent as per the Memorandum of Agreement.
ArcView Classes  
Mr. Vacca is attending the classes on the 14th and the 16th.  The Commissioners will let Becky or Rich know if they want to attend as well.
